“Government Accountability Office recommends that OSHA assess—as soon as feasible and, as appropriate, periodically thereafter—various challenges related to resources and to communication and guidance that the agency has faced in its response to the COVID-19 pandemic and take related actions as warranted.” The Labor Department partially agreed. Here are some of the other recent headlines you might have missed.”

GET HELP: FEDERAL VACCINE MANDATE

Side Effects of Vaccination to Be Covered under FECA
Published: October 19, 2021
“The executive order makes those vaccinations “a requirement of most federal employment. As such, employees impacted by this mandate who receive required COVID-19 vaccinations on or after the date of the executive order [September 9] may be afforded coverage under the FECA for any adverse reactions to the vaccine itself, and for any injuries sustained while obtaining the vaccination.”
“Decisions on claims will include a consideration of whether the employee followed agency policy in getting the vaccination, it added.”
Scenarios of COVID-19 Vaccine Side Effects
0. A sincere question, even if you achieve a sustainable immunity to COVID-19 through the vaccine, does your immunity belong to you or the patent holders of the gene therapy you took?
“THE US Patent and Trademarks Office ruled on the most-watched patent proceeding of the 21st century: the fight for Crispr-Cas9. The decision was supposed to declare ownership of the rights to the revolutionary gene editing technique. But instead, the patent judge granted sorta-victories to each of the rival parties—a team from UC Berkeley and another with members from both MIT and Harvard University’s Broad Institute. That’s great for those groups (and their spin-off, for-profit gene editing companies with exclusive licenses)”
“nd while exclusive licenses aren’t rare in biotech, the scope of these do stand out: They cover all the 20,000-plus genes in the human genome.”
” In 1980, shortly after the Supreme Court ruled
that genetically engineered microbes were patentable, Congress passed something called the Bayh-Doyle Act. The law gives
permission for universities to patent—and license—anything their researchers invented with public funds, making it easier
to put those inventions back in the hands of citizens.
The law’s original intent was to patent mature discoveries, things like a genetically modified crop, or biofuel-farting yeast.
Over the years, however, universities started filing patents further upstream—on everything from protein structures to bits of
DNA”
“These biotechs are surrogates for patent holders like Berkeley and the Broad, taking over the role of
patent owner (plus the majority of profits)”

They concluded that certain cases it does.”

So will Department of Labor show that it chooses to act as a true local autonomous entity for federal workers and beyond if adverse reactions to the vaccine increases?
“Aged individuals with compromised immunity are highly susceptible to COVID-19 and the likelihood of mortality increases with age and the presence of comorbidities such as hypertension, diabetes mellitus, cardiovascular disease, or chronic obstructive pulmonary disease. Emerging evidence suggests that COVID-19 highjacks mitochondria of immune cells, replicates within mitochondrial structures, and impairs mitochondrial dynamics leading to cell death. Mitochondria are the powerhouses of the cell and are largely involved in maintaining cell immunity, homeostasis, and cell survival/death. Increasing evidence suggests that mitochondria from COVID-19 infected cells are highly vulnerable, and vulnerability increases with age. The purpose of our article is to summarize the role of various age-related comorbidities such as diabetes, obesity, and neurological diseases in increasing mortality rates amongst the elderly with COVID-19.”

And what we’re really trying to do is accelerate the pace of research so that we can get as many drugs in the clinic as quickly as possible. One of the big bottlenecks was having this mRNA for the scientist to run tests in. So, what we did is we put in place a ton of robotic automation, put in place a lot of digital systems and process automation and AI algorithms as well. And [we] went from maybe about 30 mRNAs manually produced in a given month to a capacity of about a thousand in a month period”

By the authority vested in me as President of the United States by the Constitution and the laws of the United States of America, it is ordered as follows:
Section 1. Nondiscrimination in Federal Employment on the Basis of Protected Genetic Information.
1-101. It is the policy of the Government of the United States to provide equal employment opportunity in Federal employment for all qualified persons and to prohibit discrimination against employees based on protected genetic information, or information about a request for or the receipt of genetic services. This policy of equal opportunity applies to every aspect of Federal employment.

“First, GLP is a quality management system, not a scientific management system. Or, in other words, GLP defines a set of quality standards for study conduct, data collection, and results reporting. GLP does not define scientific standards. If a study follows GLP, then you can be reasonably sure that the reported results were collected as outlined in the study protocol; however, you cannot be sure that the study actually addresses the scientific hypothesis. In the world of cooking, GLP would ensure that someone follows the recipe exactly as written; however, it does not assure you that the recipe was good or that the resulting item will be tasty!”

Congressional Research Development: Legal Issues in COVID-19 Vaccine Development and Deployment
Updated November 25, 2020
https://crsreports.congress.gov/product/pdf/R/R46399
Congress’s authority to mandate vaccination, on the other hand, must emanate from its enumerated powers in the Constitution. Two potential sources of such power, the Spending Clause and the Commerce Clause, are subject to certain constraints that can limit the scope of a federal vaccination mandate.
Legal liability for injuries caused by a COVID-19 vaccine is likely to be subject to specialized rules under the Public Readiness and Emergency Preparedness (PREP) Act. To encourage the expeditious development and deployment of medical countermeasures, the Secretary of HHS declared COVID-19 a public health emergency and invoked the PREP Act for COVID-19 countermeasures. Under HHS’s declaration, covered persons—including COVID-19 vaccine developers, manufacturers, distributors, and health care professionals who administer a vaccine—are generally immune from legal liability for losses relating to administration or use of an FDA-approved COVID-19 vaccine, except for willful misconduct resulting in death or serious physical injury. However, individuals who are harmed by a COVID-19 vaccine may seek compensation through the Countermeasures Injury Compensation Program, a regulatory process administered by HHS

The U.S The Department of the Interior (DOI) Office of Civil Rights – Disability and Religious Accommodations
• Title VII of the federal Civil Rights Act of 1964 requires U.S. employers, including government agencies, to accommodate employees whose religious beliefs and practices conflict with work requirements — so long as it doesn’t create an “undue hardship” for the employer, Reiss explains. That means workplace administrators must let employees request an exemption if vaccines are required for work, but don’t have to grant them.
An accommodation “may cause undue hardship if it is costly, compromises workplace safety, decreases workplace efficiency, infringes on the rights of other employees, or requires other employees to do more than their share of potentially hazardous or burdensome work,” according to the U.S. Department of Labor. In 1977, the U.S. Supreme Court interpreted “undue hardship” to mean incurring more than a de minimis, or minimal, expense.
Title VII applies to employees at colleges and K-12 schools, but not students. State law generally governs whether college students and kids in kindergarten through high school can ask to be exempted from receiving the various vaccines required for enrollment. Because of that, policies vary considerably across the U.S.
As of mid-September, 26 of the nation’s 50 biggest public university campuses did not require students to get inoculated against COVID-19, an analysis from The Associated Press finds.
